So, you've had some bad luck with your credit score. No problem. You can fix your credit report and get a much better rating. It is not difficult. You only need to know that it works and you have to be a little persistent.

How do I know? Well, a few years ago I had my appendix removed. As I had no health insurance the $25,000 in hospital bills were a little difficult to manage to say the least. After a couple of month some "nice" collecting agency pestered me with calls.

I finally paid the whole thing by putting it on different credit cards. The reward: that "nice" collecting agency happily reported everything to the credit bureaus, even though they promised that they would not.

Since that time my credit sucked (sorry my French there) and I was "enjoying" some rather interesting rates on my credit cards and mortgage. Twenty-seven to twenty-nine percent. Yes, 27 to 29% - outch.

All these years I thought well, there is nothing that you can do. But the other day I was enjoying a cup of coffee with my wife at my favorite Starbucks.

Just the day before I was looking at my credit report and there I happen to sit next to a girl that works for a collecting agency. You might call it coincidence. Anyhow, I told her my story and then she gave me the solution:

Just write to the credit bureau and ask them to remove the entry.

I went, well they will not do that. Already tried a year ago online. No, she says you have to write real letters. And they basically have to remove it. If you send them a letter stating that the item is not valid, they have to prove you wrong, she said. Now, in most cases they can not prove that the item is true, and it will be removed. It takes about 30 to 45 days. Once the credit burea receives your letter, they will inquire about the item at the collection agency. They will give the collection agency 30 days time to respond. If they do not respond by then, the item will be removed. Cool, right?

Nobody is allowed to remove accurate negative information from a credit report, but the law does allow you to request an investigation of information in your file that you dispute as inaccurate or incomplete.

It is perfectly legal to challenge ANYTHING on your credit report.

You absolutely have the right to challenge inaccurate or incomplete data in your credit report. If you can locate information in your credit file that is not complete or not accurate, and then report it to the credit bureau, the credit agency has to investigate it unless your dispute is frivolous.

As the girl from the collection agency told me, collection agencies usually don't get the original document. What that means in plain english: a collection agency is usually not able to prove the claim.

The Consumer reporting agencies, like Experian, Equifax and TransUnion, must correct or erase not accurate, not complete, or not verifiable information. Inaccurate, not complete or not verifiable data must be removed or replace with corrected data, usually within one month. If the consumer reporting agency can prove that the information is correct, they may continue to show it.
